1. Introduction

Welcome to Zara TV, an OTT platform providing adult-oriented content tailored to meet the unique preferences of our audience. By accessing or using our services, you agree to be bound by these Terms and Conditions (“Terms”), which govern your use of the platform. If you do not agree with any part of these Terms, you must immediately discontinue the use of our services.

2. Eligibility

The platform is strictly available to individuals aged 18 years or older. By accessing or using the platform, you affirm that you are of legal age and have the legal capacity to enter into a binding agreement as per applicable laws. Zara TV reserves the right to terminate access for any user who provides false or misleading eligibility information.

3. Membership and Account Security

Registration

To access premium content and features, Users must create an account by providing accurate, complete, and up-to-date information. Inaccurate or incomplete registration details may result in restricted access or account termination.

Account Confidentiality

Users are responsible for maintaining the confidentiality of their account credentials and are liable for all activities conducted under their account. Zara TV shall not be held responsible for unauthorized access caused by the User’s negligence.

Notification of Breach

Users must immediately notify Zara TV of any unauthorized use of their account or any other security breach. Failure to do so may result in suspension or termination of account access.

4. User Conduct

Users are expected to use the platform responsibly and in compliance with applicable laws and regulations. The following activities are strictly prohibited:

  • Using the platform for illegal, abusive, or defamatory purposes.
  • Sharing, duplicating, or redistributing content without authorization.
  • Interfering with the platform’s technical operations or attempting to bypass security mechanisms.

Any breach of this clause may result in account suspension, termination, or legal action.

5. Content Usage and Restrictions

License Grant

Zara TV provides a limited, non-exclusive, non-transferable license to access and view the content available on the platform solely for personal and non-commercial purposes.

Ownership

All content, including videos, graphics, logos, and text, is owned by Zara TV or its licensors and is protected under intellectual property laws.

Prohibited Activities

Users are prohibited from copying, modifying, distributing, transmitting, or creating derivative works from the platform’s content without prior written consent. Any unauthorized use will constitute a material breach of these Terms.

6. Payment and Billing

Subscription Plans

Access to premium content requires a valid subscription. Subscription plans are offered on a recurring basis, with fees charged in advance.

Payment Authorization

By subscribing, Users authorize Zara TV or its payment processors to charge applicable fees to the provided payment method.

Automatic Renewal

Subscriptions will automatically renew unless cancelled by the User at least 24 hours before the next billing cycle.

Refunds

All subscription fees are non-refundable except in cases of service interruptions directly attributable to Zara TV. Refund requests must be submitted within 7 business days of the billing date.

7. Intellectual Property Rights

Zara TV retains exclusive rights to all content and trademarks associated with the platform. Users acknowledge that their use of the platform grants them no ownership or other rights over its content. Any unauthorized reproduction, distribution, or commercial exploitation of content may result in legal consequences.

8. Termination

Zara TV reserves the right to suspend or terminate a user’s account without prior notice if:

  • The User violates these Terms or engages in prohibited activities.
  • The User provides false or misleading account information.
  • Required payment obligations are not fulfilled.

Terminated Users are prohibited from creating new accounts without prior approval from Zara TV.

9. Disclaimers and Limitation of Liability

No Warranties

The platform and its content are provided “as is” without any express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.

Limited Liability

Zara TV shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform.

Force Majeure

The platform shall not be held responsible for interruptions caused by unforeseen circumstances, including but not limited to natural disasters, technical failures, or governmental actions.

10. Privacy Policy

All personal data collected through the platform is handled in accordance with Zara TV Privacy Policy, which outlines how information is collected, used, and protected. Users are encouraged to review the Privacy Policy regularly.

11. Changes to Terms

Zara TV reserves the right to amend these Terms at its sole discretion. Any updates to the Terms will be communicated via email or posted on the platform. Continued use of the platform constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. All disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
